Regulation 64

Issue and renewal of airfield vehicle permit

Subregulation 1

Upon an application made under by-law 63 in respect of a motor vehicle, the airport licensee may issue or renew an airfield vehicle permit if the airport licensee is satisfied that —

(a)

a valid vehicle licence has been issued for the motor vehicle under the Road Traffic Act 1961 and is in force;

(b)

the registration of the motor vehicle has been waived under rule 3A of the Road Traffic (Motor Vehicles, Registration and Licensing) Rules (R 5); or

(c)

a valid certificate has been issued by an inspection agency approved by the airport licensee for the motor vehicle and is in force.

Subregulation 2

The airport licensee may, at the time of issuing or renewing an airfield vehicle permit under paragraph (1), impose any condition that the airport licensee thinks fit.

In determining an application made under by-law 63 for a motor vehicle, the airport licensee may consider one or more of the following factors:

(a)

the safety and security of the airport;

(b)

the operational and technical requirements of the airport, which include —

(i)

the capacity of the airside;

(ii)

the traffic flow within the airside;

(iii)

whether the infrastructure of the airport supports the use of the motor vehicle within the airside; and

(iv)

whether the use of the motor vehicle within the airside is consistent with the sustainable development of the airport;

(c)

environmental protection, which includes —

(i)

the energy efficiency of the motor vehicle; and

(ii)

the need to reduce the carbon emissions of motor vehicles within the airside;

(d)

the availability of other motor vehicles in the market that —

(i)

run on an alternative fuel or power which serves as a substitute for fossil fuel (such as electricity); and

(ii)

are suitable for the operational and technical requirements of the airport,whether or not the applicant owns any such motor vehicles;

(e)

any other factor that the airport licensee considers to be relevant to ensure the efficient, safe, secure and sustainable operation of the airport.
