Regulation 35

Service of documents

Subregulation 1

Without affecting section 78 of the Act, any document required to be served on the appellant for the purpose of any appeal proceedings under these Regulations may be served —

(a)

where the appellant is an individual, by leaving it at the address for service stated in the appellant’s notice of appeal;

(b)

where the appellant is a partnership or a body corporate, by leaving it at, or by sending it by prepaid registered post to, the address for service stated in the appellant’s notice of appeal; or

(c)

where the appellant has stated an email address for service of documents in the appellant’s notice of appeal, by sending it by email to that email address.

Subregulation 2

Any document required to be served on the Authority for the purpose of any appeal proceedings under these Regulations must be sent to the Authority by email to the email address for service stated in the Authority’s reasons filed under regulation 12(1).

Subregulation 3

Where it appears to the Appeal Advisory Committee that there is a good reason to authorise service by a method not permitted by the Act or these Regulations, the Committee may, on the request of a party or on its own initiative, make an order permitting and specifying an alternative method of service.

Subregulation 4

The Appeal Advisory Committee may dispense with service of a document if the interests of justice so require.
