Irregularities
Subregulation 1
Any irregularity resulting from a failure to comply with any provision of these Regulations before the Minister has reached his or her decision does not of itself render the appeal proceedings void.
Subregulation 2
Where any such irregularity comes to the attention of an Appeal Advisory Committee, the Committee —
must, if the Committee considers that any person may have been prejudiced by the irregularity, give directions to cure or waive the irregularity before submitting its report to the Minister under regulation 31; and
may, in any other case, give directions to cure or waive the irregularity before submitting its report to the Minister under regulation 31.
Subregulation 3
An Appeal Advisory Committee is entitled to take into account any irregularity in its report to the Minister under regulation 31.
Subregulation 4
The following may be corrected at any time by the chairperson or alternate chairperson (as the case may be) of an Appeal Advisory Committee by certificate under his or her hand:
clerical mistakes in any document recording a direction or any appeal proceedings under these Regulations;
errors arising in such a document from an accidental slip or omission.
