Regulation 43
Determination of questions about entitlement to patents, etc., before grant (section 20(7)) or right to patents after grant (section 47(8))
Subregulation 1
This rule applies where the Registrar declines to deal with a question under section 20(7) or 47(8).
Subregulation 2
A person entitled to do so may apply to the Court to determine the question.
Subregulation 3
An application under paragraph (2) must be made —
(a)
within one month after the Registrar’s decision; and
(b)
by original application.
