Regulation 10
Revocation or suspension of licence
Subregulation 1
Subject to paragraphs (2), (3) and (4), the Minister may revoke or suspend a licence if —
the licensee is convicted of an offence under the Act or these Regulations or any other written law relating to air navigation or air transport;
the licensee being a body corporate, any of its officers is convicted of such an offence;
the licensee has failed to comply with or contravened any of the provisions of these Regulations or any condition of his licence; or
the licensee has, in his application for the licence, furnished information which is false or misleading.
Subregulation 2
Before revoking or suspending a licence under paragraph (1), the Minister shall by notice in writing inform the licensee of the grounds upon which it is proposed to revoke or suspend the licence.
Subregulation 3
The Minister shall not revoke or suspend a licence unless he is satisfied, after having caused an inquiry to be held if the licensee (by notice in writing) requires him to do so, that the licence should be revoked or cancelled.
Subregulation 4
The Minister shall inform the licensee of the date, time and place of such inquiry and shall give him an opportunity of being heard.
Subregulation 5
The Minister may —
appoint such person or persons as he thinks fit to hold an inquiry under this regulation; and
give to such person or persons directions not inconsistent with these Regulations as to the manner in which the inquiry shall be held and the matters into which such inquiry shall be made.
Subregulation 6
Such person or persons shall submit a report on the findings of the inquiry and his or their recommendations to the Minister.
Subregulation 7
Notwithstanding paragraphs (2) and (3), if the Minister is of the opinion that immediate suspension of a licence is necessary in the public interest, he may suspend the licence with immediate effect.
Subregulation 8
For the purposes of paragraph (1)(b), “officer” means a director, general manager or other officer and includes any person who is authorised to act as such.
