Section 133

Examination of complainant

(1)

When a Magistrate takes cognizance of an offence on complaint he shall at once examine the complainant upon oath.

(2)

The substance of the examination shall be reduced to writing and shall be signed by the complainant and also by the Magistrate.

(3)

This section shall not apply to —

(a)

a complaint made by a police officer or by a public servant as defined in the Penal Code acting in his public capacity in respect of an offence punishable with imprisonment for a period not exceeding 6 months or with fine only; or

(b)

a complaint by a public officer in respect of any offence against any law relating to local government or any by-laws or rules made thereunder for the time being in force,provided that the complaint is in writing and signed by the police officer or public servant.[132
