Section 161

Regulatory control over law corporation

(1)

The Director of Legal Services may, by written notice to a law corporation, do any of the following things, if the Director of Legal Services is satisfied that there is sufficient reason for doing so:

(a)

suspend or revoke the law corporation licence which was issued to the law corporation;

(b)

order the law corporation to pay a penalty of not more than $100,000;

(c)

give a warning to the law corporation.

Without limiting subsection (1), the Director of Legal Services may, by written notice to a law corporation, do anything referred to in subsection (1)(a), (b) or (c), if —

(a)

the law corporation contravenes Part 5A or any rules made under section 70H, or fails to comply with any requirement under this Division;

(b)

the law corporation fails to comply with any condition subject to which its law corporation licence was issued; or

(c)

the Director of Legal Services is satisfied that it is in the public interest to do so.

Before doing under subsection (1) or (2) anything referred to in subsection (1)(a), (b) or (c), the Director of Legal Services must give the law corporation not less than 14 days after the date of the notice to make representations in writing.
