Reference and transfer of cases to Health Committee
of Pharmacists Registration Act 2007
(1)
Where, in the course of inquiring into the case of a registered pharmacist, it appears to a Disciplinary Committee that the registered pharmacist’s fitness to practise may be impaired by reason of his or her physical or mental condition, the Disciplinary Committee may refer that question to the Health Committee for determination.
(2)
If, on a reference under this section, the Health Committee determines that the fitness of the registered pharmacist to practise is not impaired by reason of his or her condition, the Health Committee must certify its opinion to the Disciplinary Committee.
(3)
If, on a reference under this section, the Health Committee determines that the fitness of the registered pharmacist to practise is impaired by reason of his or her condition, the Health Committee must —
certify its opinion to the Disciplinary Committee; and
proceed to dispose of the case,and the Disciplinary Committee ceases to exercise its function in relation to the case.
