Regulation 34

This Rule applies without the need for an order from the Court.

Where costs are payable by the appellant to the respondent under any order made by the appellate Court, the security for costs provided under Rule 30 must be paid to the respondent towards the costs ordered and the balance (if any) of the security must be paid to the appellant.

Where no costs are payable by the appellant to the respondent under any order made by the appellate Court, the security for costs provided under Rule 30 must be paid to the appellant and the appellant’s solicitor is released from any undertaking as to the costs for the appeal.

Paragraphs (2) and (3) apply with necessary modifications to the payment out of security for costs given under Rule 35(5).
