Application for permission under section 40(4)(b) or 58(4)(b) of Supreme Court of Judicature Act (O. 18, r. 36)
An application for the permission of —
(a)
a Judge sitting in the Appellate Division under section 40(4)(b) of the Supreme Court of Judicature Act, to make an application to discharge or vary any direction or order mentioned in section 40(4)(a) of that Act; or
(b)
a Judge sitting in the Court of Appeal under section 58(4)(b) of the Supreme Court of Judicature Act, to make an application to discharge or vary any direction or order mentioned in section 58(4)(a) of that Act,must be filed and served on all parties who have an interest in the appeal within 14 days after the date on which that direction or order is made.
