Amendment of section 39A and new Division 2 heading of Part 6A
of Scams (Countermeasures) and Other Matters Bill
In the Miscellaneous Offences Act, in section 39A —
in subsection (1), after the definition of “compromised SIM card”, insert —“ “designated online account” means an online account on a designated online service;“designated online service” means an online service designated as a designated online service under section 20(1) of the Online Criminal Harms Act 2023;“online account” means an account (including a free account, a prepaid account and anything that may reasonably be regarded as the equivalent of an account) on an online service;“online service” has the meaning given by section 2(1) of the Online Criminal Harms Act 2023;”; and
after subsection (3) (including the Illustration), insert —“(4) For the purposes of this Part —
a reference to a person (C) selling, renting, lending or supplying a designated online account to another person (D) includes a reference to C selling, renting, lending or supplying to D any information (such as a username, a password or a user authentication code) that D may use to obtain control of the designated online account; and
a reference to C buying, renting, borrowing or receiving a designated online account from D includes a reference to C buying, renting, borrowing or receiving from D any information (such as a username, a password or a user authentication code) that C may use to obtain control of the designated online account.Division 2 — SIM cards”.
