Related and consequential amendments to Banking Act 1970
of Scams (Countermeasures) and Other Matters Bill
In the Banking Act 1970 —
in section 55(2)(q), delete “and” at the end;
in section 55(2)(r), replace the full‑stop at the end with “; and”;
in section 55(2), after paragraph (r), insert —“(s)the requirement of a bank or a class of banks to comply with a disclosure order issued to the bank or class of banks by a specified officer under section 6G(1) or (2) of the Protection from Scams Act 2025 or such disclosure orders generally.”; and
in the Third Schedule, in Part 1, after item 10, insert —“11.Disclosure is required under section 5A of the Protection from Scams Act 2025.All persons to whom the disclosure is required to be made under that section. 12.Disclosure is necessary to comply with an order issued to the bank by a specified officer under section 6G(1) or (2) of the Protection from Scams Act 2025.All persons to whom the disclosure is directed to be made under the order. 13.Disclosure is made in the circumstances mentioned in section 9A(2) of the Protection from Scams Act 2025.All persons mentioned in section 9A(2)(c) of the Protection from Scams Act 2025. ”.
