Regulation 49

Power to demand names and addresses, etc.

Subregulation 1

An authorised person may require a person whom the authorised person has reasonable grounds to suspect is about to contravene, has contravened or is contravening any provision of these Regulations, to provide the person’s name, address or other proof of identity on demand.

Subregulation 2

A person who —

(a)

without reasonable excuse, contravenes paragraph (1); or

(b)

in providing any information so required under paragraph (1), makes a statement which the person knows to be false, or recklessly makes a statement which is false,shall be guilty of an offence and shall be liable on conviction —

(c)

for a first offence, to a fine not exceeding $20,000; and

(d)

for a second or subsequent offence, to a fine not exceeding $40,000 or to imprisonment for a term not exceeding 15 months or to both.
