Section 40

Any person contravening section 35, 36, 37 or 38 shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $1,000 or to imprisonment for a term not exceeding one year and on a second or subsequent conviction to a fine not exceeding $2,000 or to imprisonment for a term not exceeding 2 years for every such offence.
