Section 25

Additional terms of supply of electricity

(1)

Where any person requires a supply of electricity, a market support services licensee or a transmission licensee may require (or may cause a retail electricity licensee to require) that person to accept in respect of the supply —

(a)

any condition requiring the person to provide sufficient premises and to construct such rooms, buildings or structures as may be considered necessary by the licensee to accommodate and house the electrical plant required for the purposes of the supply;

(b)

any condition giving the licensee the right to use the premises, rooms, buildings or structures provided or constructed under paragraph (a) for the purposes of the supply; and

(c)

any restriction which must be imposed for the purpose of enabling the licensee to comply with this Act and its licence.

(2)

If a retail electricity licensee is required to secure the provision or acceptance of any one or more of the conditions or restrictions referred to in subsection (1), the retail electricity licensee must do all things necessary to secure the provision or acceptance of such conditions or restrictions as may be required in each particular case.
