Regulation 6
Basel permit or special permit
Subregulation 1
An application under regulation 3, 4 or 5 must state that the applicant is applying for —
a Basel permit; or
a special permit under a specified set of Article 11 regulations.
Subregulation 2
If —
an application under regulation 3, 4 or 5 states that the applicant is applying for a Basel permit; and
the Director‑General is satisfied that there are special circumstances relating to the application,the Director‑General may, by writing, determine that the Act and these Regulations have effect as if the applicant had applied instead for the corresponding type of special permit under a set of Article 11 regulations specified in the determination.
Subregulation 3
If —
an application under regulation 3, 4 or 5 states that the applicant is applying for a special permit under a particular set of Article 11 regulations; and
the Director‑General is satisfied that there are special circumstances relating to the application,the Director‑General may, by writing —
determine that the Act and these Regulations have effect as if the applicant had applied instead for the corresponding type of Basel permit; or
determine that the Act and these Regulations have effect as if the applicant had applied instead for the corresponding type of special permit under another set of Article 11 regulations specified in the determination.
Subregulation 4
A determination under this regulation has effect accordingly.
Subregulation 5
Where the Director‑General makes a determination under this regulation, the Director‑General must give the applicant a copy of the determination as soon as practicable.
