Section 8A

Consideration of application

(1)

Subject to subsection (2), the Presidential Elections Committee must issue a certificate of eligibility in the prescribed form to an applicant if the Committee is satisfied that —

(a)

the applicant is a person of integrity, good character and reputation for the purposes of Article 19(2)(e) of the Constitution; and

(b)

the applicant has met the service requirements in Article 19(2)(g) of the Constitution.

(2)

The Presidential Elections Committee —

(a)

may, subject to paragraph (b), reject an application if it is not made according to this Act; and

(b)

must reject an application if the applicant did not submit a community declaration in accordance with Division 3.

To avoid doubt, subsection (2)(b) includes a case in a reserved election where the applicant does not state in his or her community declaration that he or she considers himself or herself to be a member of the community to which the election is reserved.
