Section 12

Every registered private education institution must obtain the prior approval of the Agency before changing its name, or the name of any premises or school (or any department or faculty thereof) of, or any education provided by, the private education institution to a new name.

For the purposes of subsection (1), a manager of the registered private education institution which intends to effect a change of name under subsection (1) must submit to the Agency an application for approval of the new name in the form and manner that may be prescribed, and that application must be accompanied by the prescribed fee.

The Agency may refuse to grant its approval under subsection (1) if it is satisfied that the new name of the private education institution, or the premises, school (or any department or faculty thereof) or education provided by the private education institution (as the case may be) is a name which is referred to in section 10(1)(h).[39
