Amendment of section 8
of Scams (Countermeasures) and Other Matters Bill
In the Protection from Scams Act, in section 8 —
replace subsection (1) with —“(1) The Commissioner may designate any of the following persons to hear and determine, in the Commissioner’s place, appeals generally or a class of appeals or any specific appeal:
for appeals against decisions of specified officers under this Act in relation to restriction orders — an appropriate officer;
for appeals against decisions of specified officers under this Act in relation to service limitation orders or account disabling orders — a police officer not below the rank of superintendent or any other specified officer of a rank equivalent to superintendent.”;
in subsection (2), replace “subsection (1)” with “subsection (1)(a)”; and
after subsection (2), insert —“(2A) Upon a designation under subsection (1)(b), any reference in section 7 to the Commissioner includes a reference to the specified officer so designated for that appeal.”.
