40L. Exceptions

This Part does not apply in relation to a vessel.
Regulations 40BA and 40C do not apply in relation to construction sites.
Regulations 40BA and 40C do not apply in relation to a consumer who proves to the satisfaction of the Board that the consumer attained the water use threshold at a site or sites only by reason of any of the following events:
a water leakage at the site;
water usage due to an activity that does not occur on a regular basis.
Regulation 40K does not apply in relation to a water usage area at a site if the consumer that is supplied with water at the water usage area proves to the satisfaction of the Board that it is not reasonably practicable to install a private meter.
