39. Consequential amendments to MPA Act

In the MPA Act —

in section 2(1), in the definition of “appointed officer”, replace “section 89A(1)” with “section 89H(1)”;

in section 2(1), after the definition of “premises”, insert —“ “Public Utilities Board” means the Public Utilities Board continued under section 3 of the Public Utilities Act 2001;”;

in section 2(1), before the definition of “seaman”, insert —“ “reservoir” means a body of water maintained as a reservoir by the Public Utilities Board in the following areas as defined in regulations made under section 72 of the Public Utilities Act 2001:

a Catchment Area Park;

the Central Water Catchment Area;”;

in section 2(1), after the definition of “vessel”, insert —“ “waterway” has the meaning given by section 2 of the Public Utilities Act 2001;”;

in the following provisions, replace “public licensee” with “licensee under Part 12”:Section 7(1)(f)Section 9(1)(b), (6)(a) and (8)Section 90;

in sections 7(1)(h) and 9(6)(b), replace “public licensees” with “licensees under Part 12”;

in section 27(1A)(a), replace “Fourth Schedule” with “Sixth Schedule”;

in section 86A(1), in the definition of “essential transport service”, replace paragraphs (a) and (b) with —“(a)any regulated service; or”;

delete section 86HE;

in section 90, replace “public licence” with “licence under Part 12”;

in section 97D (as renumbered by section 36(1)), in subsection (6), replace “section 89C” with “section 89J”;

in sections 102(2) and 111(2)(b), replace “section 89C” with “section 89J”;

in section 111, delete subsection (1);

in section 118A, in the section heading, replace “Fourth Schedules” with “Sixth Schedules”;

in section 118A, replace “Fourth Schedule” with “Sixth Schedule”;

in the Second Schedule, in paragraph 2, replace “marine and port services and facilities” with “marine services and users of marine facilities”; and

in the Second Schedule, in paragraph 4, replace “port services and facilities” with “marine services and marine facilities”.
