Pharmacists Registration (Registration of Pharmacists) Regulations 2013

The form to be used for the purpose of an application for registration as a pharmacist under the Act is that set out at the Council’s Internet website at http://www.spc.gov.sg, and every such application shall be accompanied by all of the following:

In deciding whether to impose any condition or restriction under section 18(2)(a) of the Act, the Council shall have regard to the advice of the Board, under section 37(1)(f) of the Act, on any matters affecting, or connected with the registration of, a particular specialist or specialists generally.

An examination referred to in sections 17(2) and (3)(c), 19(2) and 26(4) of the Act (referred to in this regulation as the relevant provisions) shall be one on the following subjects:

For the purpose of conducting any examination referred to in paragraph (1), the Council may —

The date and place of any examination referred to in the relevant provisions of the Act and the manner in which the examinations are to be conducted shall be as set out at the Council’s Internet website at http://www.spc.gov.sg.

An applicant who is required by the Council to undergo any examination under the relevant provisions of the Act shall be entitled to only 3 attempts at each such examination.

An application for the restoration of any name to an appropriate register shall be made in such form and manner as may be set out at the Council’s Internet website at http://www.spc.gov.sg and shall be accompanied by the appropriate fee specified in the Schedule.

For the purposes of paragraph (1), the Council may require the applicant to furnish proof that he has adequate knowledge to practise pharmacy and, for that purpose, may require the applicant to attend such courses of instruction as the Council may determine.

In addition to the requirements in paragraph (2) —

The Council may, if it thinks fit in any case or class of cases, dispense with any requirement referred to in this regulation.

The Council may, if it thinks fit, require further evidence or information from an applicant under this regulation.

On receipt of an application referred to in regulation 7, the Registrar shall refer the application to the Council for consideration.

Except with the leave of the Council, the applicant shall not appear before the Council on the consideration of the application.

The Council shall consider the application in private and may, if it thinks fit, adjourn the consideration to a future date or require the applicant to be examined by medical practitioners to be appointed by the Council.

Where a certificate of registration has been lost or destroyed, or has been defaced or obliterated such that any particulars in the certificate are illegible, the holder thereof shall immediately apply to the Council for a duplicate of the certificate of registration.

Subject to paragraphs (4) and (5), the Council shall, on payment of the appropriate fee specified in the Schedule, if it is satisfied that the certificate of registration has been lost, destroyed, defaced or obliterated, issue a duplicate of such certificate to the holder of the original thereof.

A duplicate of a certificate of registration shall have the same effect as the original.

In the case of a certificate of registration which has been defaced or obliterated, no duplicate of such certificate shall be issued unless the original certificate is returned to the Council.

In the case of a certificate of registration which has been lost or destroyed, no duplicate of such certificate shall be issued unless the holder thereof makes a statutory declaration of the loss or destruction and furnishes the statutory declaration to the Council.

Where any original certificate of registration is found after any duplicate thereof is issued under this regulation, the holder of the certificate shall, within 14 days after the original certificate being found, return the duplicate to the Council for cancellation.

Any person who fails to comply with paragraph (6) shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $1,000.

The Pharmacists Registration Rules (R 2) (referred to in this regulation as the revoked Rules) are revoked.

Notwithstanding anything in these Regulations, an application for registration made in accordance with the revoked Rules and pending on 5th March 2013 shall be treated as an application made under the corresponding provisions of these Regulations.

Notwithstanding anything in these Regulations, an application for restoration of registration made in accordance with the revoked Rules and pending on 5th March 2013 shall be treated as an application made under the corresponding provisions of these Regulations.
