Regulation 40A
Removal of structure in reservoir or waterway
Subregulation 1
Despite any approval given under regulation 7B, or clearance certificate or approval given under section 33 of the Sewerage and Drainage Act 1999, for a structure in a reservoir or waterway, where an authorised officer is satisfied that the structure or any part of the structure, or anything on the structure or part, is or is likely to —
affect the safety, health or wellbeing of persons in or around the reservoir or waterway;
obstruct or hinder the maintenance or use of the reservoir or waterway;
affect the treatability of the water in the reservoir or waterway; or
damage property belonging to or under the management or control of the Board,the authorised officer may issue a direction to the owner of the structure to move or remove the structure or the part of the structure (as the case may be), or to take measures to mitigate or rectify the situation, within the time specified by the authorised officer and at the owner’s cost.
Subregulation 2
An authorised officer may take all necessary steps to move or remove the structure or the part of the structure mentioned in paragraph (1), or to take any measures to mitigate or rectify the situation, if —
the authorised officer is unable to find the owner of the structure, despite taking reasonable steps to do so; or
the owner of the structure that has been issued a direction under paragraph (1) fails to comply with that direction.
