Citation and commencement
These Regulations may be cited as the Public Utilities (Reservoirs, Catchment Areas and Waterway) Regulations 2006 and shall come into operation on 1st July 2006.

Part I
Citation and commencement
These Regulations may be cited as the Public Utilities (Reservoirs, Catchment Areas and Waterway) Regulations 2006 and shall come into operation on 1st July 2006.
Definitions
In these Regulations, unless the context otherwise requires —“authorised officer” means an officer of the Board or any person authorised by the Board to perform any function or duty or to exercise any power for the purposes of these Regulations;“Authority” means the Maritime and Port Authority of Singapore established under the Maritime and Port Authority of Singapore Act (Cap. 170A);“Catchment Area Park” means any area described in the First Schedule;“Central Water Catchment Area” means any area described in the Second Schedule;[Deleted by S 625/2025 wef 01/10/2025]“hours of darkness” means the time starting at 7 p.m. and ending immediately before 7.01 a.m. the following day;“non-power-driven vessel” means a vessel propelled by oars or by any means other than machinery, and includes a sailing vessel;“operator”, in relation to a vessel, means the person who ordinarily has charge or control over the use of the vessel;“owner”, in relation to a vessel, means any person who —
is the sole, joint or part owner of the vessel;
has possession or control of the vessel which is subject to the terms of a hire-purchase agreement, bill of sale or other similar instrument; or
has possession or control of the vessel under the terms of a charter agreement;“port” has the same meaning as in the Maritime and Port Authority of Singapore Act (Cap. 170A);“power-driven vessel” means any vessel propelled by machinery;“reservoir” means any water body in a Catchment Area Park or the Central Water Catchment Area;“sailing vessel” means any vessel under sail provided that propelling machinery, if fitted, is not being used;“stream” means any earth stream, canal, drain or water course in a Catchment Area Park or the Central Water Catchment Area;“vehicle” means any vehicle whether mechanically propelled or otherwise;[Deleted by S 166/2018 wef 01/04/2018]“vessel permit” means a vessel permit granted under regulation 15(1);“watercraft” means any power-driven vessel which —
is used for recreation, sports, sightseeing tours, transportation, construction or towing within a reservoir or waterway; and
includes any pleasure craft licensed by the Authority,but does not include any vessel approved by the Board for patrolling, rescue or general reservoir or waterway maintenance work and any vessel of the Singapore Armed Forces, Police Coast Guard or Singapore Civil Defence Force.
“authorised officer” means an officer of the Board or any person authorised by the Board to perform any function or duty or to exercise any power for the purposes of these Regulations;
“Authority” means the Maritime and Port Authority of Singapore established under the Maritime and Port Authority of Singapore Act (Cap. 170A);
“Central Water Catchment Area” means any area described in the Second Schedule;
“hours of darkness” means the time starting at 7 p.m. and ending immediately before 7.01 a.m. the following day;
“non-power-driven vessel” means a vessel propelled by oars or by any means other than machinery, and includes a sailing vessel;
“operator”, in relation to a vessel, means the person who ordinarily has charge or control over the use of the vessel;
“owner”, in relation to a vessel, means any person who —
is the sole, joint or part owner of the vessel;
has possession or control of the vessel which is subject to the terms of a hire-purchase agreement, bill of sale or other similar instrument; or
has possession or control of the vessel under the terms of a charter agreement;
“port” has the same meaning as in the Maritime and Port Authority of Singapore Act (Cap. 170A);
“reservoir” means any water body in a Catchment Area Park or the Central Water Catchment Area;
“sailing vessel” means any vessel under sail provided that propelling machinery, if fitted, is not being used;
“stream” means any earth stream, canal, drain or water course in a Catchment Area Park or the Central Water Catchment Area;
“vehicle” means any vehicle whether mechanically propelled or otherwise;
“watercraft” means any power-driven vessel which —
is used for recreation, sports, sightseeing tours, transportation, construction or towing within a reservoir or waterway; and
includes any pleasure craft licensed by the Authority,but does not include any vessel approved by the Board for patrolling, rescue or general reservoir or waterway maintenance work and any vessel of the Singapore Armed Forces, Police Coast Guard or Singapore Civil Defence Force.
Part V
Revocation of permit or approval
An authorised officer may revoke or suspend for a period not exceeding 12 months any permit or approval given under these Regulations if the holder of the permit or approval ––
has, in connection with any application by him for the permit or approval or renewal thereof, made any false or fraudulent declaration or representation;
has contravened any of the provisions of the Act or these Regulations; or
has contravened any of the conditions of the permit or approval.
Any person aggrieved by a decision of an authorised officer under paragraph (1) may, within 14 days of the revocation or suspension of the permit or approval, appeal in writing to the Board whose decision shall be final.
Powers of authorised officer
An authorised officer may, at any time, for the purposes of these Regulations ––
give such reasonable directions to any person using the reservoir or waterway as are in his opinion necessary for the safe and proper use of the reservoir or waterway;
require any vessel to be sent for inspection;
require and enforce the production of any permit, licence, certificate or document relating to any vessel or person on board the vessel; and
summon any person before him and require him to answer questions.
Removal of structure in reservoir or waterway
Despite any approval given under regulation 7B, or clearance certificate or approval given under section 33 of the Sewerage and Drainage Act 1999, for a structure in a reservoir or waterway, where an authorised officer is satisfied that the structure or any part of the structure, or anything on the structure or part, is or is likely to —
affect the safety, health or wellbeing of persons in or around the reservoir or waterway;
obstruct or hinder the maintenance or use of the reservoir or waterway;
affect the treatability of the water in the reservoir or waterway; or
damage property belonging to or under the management or control of the Board,the authorised officer may issue a direction to the owner of the structure to move or remove the structure or the part of the structure (as the case may be), or to take measures to mitigate or rectify the situation, within the time specified by the authorised officer and at the owner’s cost.
An authorised officer may take all necessary steps to move or remove the structure or the part of the structure mentioned in paragraph (1), or to take any measures to mitigate or rectify the situation, if —
the authorised officer is unable to find the owner of the structure, despite taking reasonable steps to do so; or
the owner of the structure that has been issued a direction under paragraph (1) fails to comply with that direction.
Fees
A fee specified in the second column of the Fifth Schedule is payable in respect of the matter specified opposite that fee in the first column.
Where the Board considers appropriate, the Board may waive, refund or remit the whole or part of a fee.
Offences
Any person who contravenes regulation 4, 5, 6 (other than paragraph (h)), 6A, 7, 7A, 11, 11A(1) or (4)(a) or (b), 15(1), 17(1) or (2), 18, 18A, 19(1), 20, 21(2), 23, 24(1), 24A(1) or 24B or any order, requisition or direction made or given under regulation 9, 11A(7), 12, 22(1) or 40 shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $3,000.
Any person who contravenes regulation 7B(1) shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $10,000.
Any person who contravenes a direction given under regulation 7B(4) or (9) or 40A(1) shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $10,000.
Any person who contravenes regulation 6(h) shall be guilty of an offence and shall be liable on conviction to —
for a first offence, a fine not exceeding $2,000;
for a second offence, a fine not exceeding $4,000; and
for a third or subsequent offence, a fine not exceeding $10,000.
Revocation
The Public Utilities (Central Water Catchment Area and Catchment Area Parks) Regulations (Rg 11) are revoked.
Transitional provision
Any approval or authorisation given by the Board or an authorised officer under the revoked Public Utilities (Central Water Catchment Area and Catchment Area Parks) Regulations shall, so far as it is not inconsistent with the provisions of these Regulations, continue and be deemed to have been granted under the corresponding provisions of these Regulations.
Board to decide on opening and closing hours
The Board may open or close a Catchment Area Park or any part thereof to the public at or between such hours as may be specified by the Board in notices exhibited thereat or as may be made known to the public by the Board in any other manner.
Vehicle in Catchment Area Park
No person shall drive a lorry exceeding a gross weight of 3 tonnes in a Catchment Area Park except with the permission of an authorised officer.
No person shall drive or ride a vehicle in or out of a Catchment Area Park except through an authorised entrance or exit.
No person shall drive or ride a vehicle within a Catchment Area Park except on such roads as are indicated by traffic or other signs to be open for use by vehicles.
Notwithstanding paragraph (3), invalid chairs and perambulators may be used on any road or footpath in any part of a Catchment Area Park.
No person shall drive or ride a vehicle with speed exceeding 25 kilometres per hour within a Catchment Area Park unless otherwise indicated by a speed limit sign.
Vehicle in Central Water Catchment Area
No person shall bring any vehicle into or cause any vehicle to be brought into the Central Water Catchment Area unless prior consent in writing of the Board or an authorised officer is obtained.
Any person driving or riding a vehicle that has been allowed entry into the Central Water Catchment Area shall drive or ride the vehicle only on such roads as are indicated by traffic or other signs to be open for use by vehicles.
Paragraph (1) shall not apply to areas which are Catchment Area Parks, public roads and lands permitted by the Board to be used by any person for any specified approved purposes including golf courses.
A person must not park a vehicle in any part of the Central Water Catchment Area which is clearly marked out as an area where parking is prohibited by signs erected by or under the authority of the Board.
Prohibited activities in Catchment Area Park
No person in a Catchment Area Park shall —
damage any plant, shrub or tree or any part of the same, or damage any flower bed, or do any act which causes damage to the flora;
kill, hunt, shoot or trap any animal or do any act which causes injury to the fauna;
bathe or wash himself or any other person, animal or thing in any reservoir or stream or pollute any reservoir or stream in any manner;
spit, urinate or defecate in any part of the grounds of the Catchment Area Park (including into any reservoir or stream therein) except in the appropriate toilet facilities provided for the purpose;

place, deposit or throw any refuse, rubbish, litter, food, bottle, glass, can or other article or thing in any place other than a refuse bin or receptacle provided for the purpose;
distribute any pamphlets, handbills or documents to other persons, or affix or post the same or any bill, placard, notice or advertisement to any wall, tree, fence or structure;
remove, damage, displace, deface or make improper use of any seat, shelter, structure, notice, label, appliance, equipment, fitting or other property belonging to or under the management or control of the Board;

destroy, damage, remove or displace any stone or granite block which is part of the structure of the reservoir; or
take water from any toilet facilities to wash any vehicle.
Prohibited activities in waterway
No person shall pollute any waterway by any means, including by —
bathing or washing himself or any other person, animal or thing in the waterway; or
spitting, urinating or defecating in the waterway.
Activities in Central Water Catchment Area and Catchment Area Park requiring prior approval
No person in the Central Water Catchment Area or in a Catchment Area Park shall, without the prior approval in writing of an authorised officer —
enter into any reservoir or stream;
(aa)enter any part of the Central Water Catchment Area or Catchment Area Park which is clearly marked out as an area to which entry is prohibited by signs erected by or under the authority of the Board;
collect any bird’s egg or nest;
remove or cut any plant, shrub or tree or any part of the same;
burn any matter or thing;
erect or assemble any tent or structure, or set up a caravan for the purpose of camping;
expose for sale or sell any merchandise, food or drink;
use any part of the Central Water Catchment Area or Catchment Area Park as a location for the shooting of a film or the setting of a play;
(ga)without affecting paragraph (a), fish in any reservoir or stream which is not clearly marked out as a designated area for fishing activities by signs erected by or under the authority of the Board;
use for fishing any bait that is not an artificial lure;
draw water from any reservoir or stream; (j)feed any aquatic animal with any kind of food; (k)release any animal;
have with him any animal other than —
a dog that is on a leash and under proper control; or
any other animal that is under proper control;
allow any animal that is on a leash or under proper control to enter into any reservoir or stream; or
consume any beverage containing alcohol at a time other than during an applicable no-public drinking period prescribed under the Liquor Control (Supply and Consumption) Act 2015.
Activities in waterway requiring prior approval
A person must not, without the prior written approval of an authorised officer —
enter into any waterway, other than any part of any waterway described in the Third Schedule when the audio and visual warning systems installed around those waterways are not activated to prohibit entry;
draw water from any waterway;
release any animal into any waterway;
fish in any waterway, other than in any part of a waterway which is clearly marked out as a designated area for fishing activities by signs erected by or under the authority of the Board; or
use for fishing in any waterway any bait that is not an artificial lure.
Installing or keeping structure in reservoir, stream or waterway
A person must not install or keep any structure in a reservoir, stream or waterway except under and in accordance with a valid approval granted by an authorised officer and any condition imposed in connection with the approval.
Paragraph (1) does not apply to any structure in a reservoir, stream or waterway that is installed or kept by the Board.
Every application for an approval must be in the form and manner determined by the Board.
If a person installs or keeps a structure in a reservoir, stream or waterway in contravention of paragraph (1), an authorised officer may issue a direction to the person to move or remove the structure or any part of the structure within the time specified by the authorised officer.
To avoid doubt, an authorised officer may issue more than one direction to the same person to move or remove the structure or part of the structure (as the case may be) within a specified time, so long as the person has not complied with any direction previously given to the person to so move or remove the structure or part of the structure.
In granting an approval under paragraph (1), the authorised officer may impose any conditions that he thinks fit, including that the structure operator of the structure must —
inspect and maintain the structure at intervals specified by the Board;
implement and maintain any mitigation measures that are required by the Board to preserve the treatability of the water in the reservoir, stream or waterway, including all or any of the following:
an online monitoring system;
a water quality sampling regime;
any other mitigation measure that is required by the Board;
keep records of —
the inspections and maintenance of the structure carried out under sub-paragraph (a); and
the implementation and maintenance of mitigation measures carried out under sub-paragraph (b),and if so required, submit the records to the Board; and
during the period that the structure is being installed, ensure that the structure is installed in accordance with any requirements that the Board may impose.
A condition mentioned in paragraph (6) may impose an obligation on or otherwise apply to a structure operator who is not the approval holder for the structure, but the Board must serve a written notice of the condition on the structure operator.
An authorised officer may at any time add to, cancel or vary any of the conditions of the approval that he thinks fit.
If a person fails to comply with a condition imposed on an approval, an authorised officer may direct the person to comply with the condition within the time specified by the authorised officer.
If a person fails to comply with a direction issued under paragraph (4) or (9), an authorised officer may take all necessary steps to —
move or remove the structure or any part of the structure; or
carry the direction into effect.
In this regulation —
“approval holder” means a person to whom an approval has been granted under paragraph (1);
“structure operator”, in relation to a structure, means —
during the period that the structure is being installed —
the approval holder for the structure;
the owner of the structure;
any person who installed the structure; or
any person who caused the installation of the structure; and
after the structure has been installed —
the approval holder for the structure;
the owner of the structure; or
any person who ordinarily has charge of, or management or control over, the operation or maintenance of the structure (whether or not the person is the approval holder for the structure).
Discretion to authorise prohibited activity
The Chairperson or the Chief Executive may, in his discretion, authorise in writing any member or employee of the Board or any person to perform or carry out any act prohibited by regulation 6, 6A, 7, 7A or 7B if he considers that —
it would be in the interest of, or for the benefit of, the Central Water Catchment Area or a Catchment Area Park; or
there exists any other good cause,for such act to be performed or carried out by the member, employee or person.
Discretion to prohibit animals from entering Catchment Area Park
Notwithstanding regulation 7(k), (l) and (m) —
an authorised officer may, in his discretion, order any person having in his charge any animal to take the animal out of any Catchment Area Park, and that person shall immediately comply with the order; and
the Board or an authorised officer may, by notice in writing, prohibit any person from taking any animal or class of animals into any Catchment Area Park.

Camp or caravan in Central Water Catchment Area or Catchment Area Park
Any person who is permitted to set up a camp or caravan under regulation 7(e) shall —
keep the camp or caravan site in a clean and tidy condition; and
remove the camp or caravan from the Central Water Catchment Area or a Catchment Area Park when directed to do so by an authorised officer.
Transportation, storage and use of fireworks in Central Water Catchment Area, Catchment Area Park or waterway
A person must not transport, store or use any fireworks in the Central Water Catchment Area, in a Catchment Area Park or in a waterway except under and in accordance with a valid approval granted by an authorised officer and any condition imposed in connection with the approval.
Every application for an approval must —
be in the form and manner determined by the Board; and
be accompanied by a plan specifying the manner in which the fireworks are intended to be transported, stored or used.
In considering whether to grant an approval under paragraph (1), the authorised officer must consider the risk of all of the following:
any harm to the safety, health or wellbeing of persons in or around the Central Water Catchment Area, Catchment Area Park or waterway;
any damage to any structure or other property in or around the Central Water Catchment Area, Catchment Area Park or waterway;
any pollution to the water in the Central Water Catchment Area, Catchment Area Park or waterway.
An approval holder must —
use the fireworks in a fireworks display session in the manner specified in the plan submitted under paragraph (2)(b); and
after a fireworks display session, recover —
all casings and shells, or parts thereof; and
all debris,from the fireworks that were used during the session, and properly dispose of the same —
within the time specified by the authorised officer in the approval, or any further time that the authorised officer may allow; and
in accordance with the directions of the authorised officer.
The conditions imposed under paragraph (1) may include a requirement that, after a fireworks display session, the approval holder must submit a written report to the authorised officer within 7 days after the day on which the session concluded on the amount of fireworks used and the amount of fireworks undischarged or unspent.
An authorised officer may at any time add to, cancel or vary any of the conditions of the approval that he thinks fit.
If an approval holder fails to comply with —
a condition imposed on the approval; or
paragraph (4)(b) in respect of sub-paragraph (iii) or (iv),an authorised officer may direct the approval holder to rectify the non-compliance within the time specified in the direction, or any further time that the authorised officer may allow.
If the approval holder fails to comply with a direction under paragraph (7), the authorised officer may do all or any of the following:
revoke the approval granted under paragraph (1);
where a permit under regulation 15(1) has been granted in connection with the use of the fireworks — revoke the permit granted under that regulation;
where an approval under regulation 24(1) has been granted in connection with the use of the fireworks — revoke the approval granted under that regulation.
If a person transports, stores or uses any fireworks in the Central Water Catchment Area, a Catchment Area Park or a waterway without obtaining an approval to do so from an authorised officer, the authorised officer may do either or both of the following:
where a permit under regulation 15(1) has been granted in connection with the use of the fireworks — revoke the permit granted under that regulation;
where an approval under regulation 24(1) has been granted in connection with the use of the fireworks — revoke the approval granted under that regulation.
In this regulation, “approval holder” means a person to whom an approval has been granted under paragraph (1).
Offenders may be ordered out of Central Water Catchment Area, Catchment Area Park or waterway
Any person who contravenes regulation 4, 5, 6, 6A, 7, 7A or 11 may be ordered out of the Central Water Catchment Area, Catchment Area Park or waterway by any police officer or authorised officer and may be refused admission thereto by the police officer or authorised officer.
This regulation shall not be construed as preventing any person from being prosecuted for any contravention of regulation 4, 5, 6, 6A, 7, 7A or 11.
Seizure of animals, vehicles, etc.
Any animal found in the Central Water Catchment Area or a Catchment Area Park in contravention of regulation 7(k), (l) or (m) or any vehicle, vessel, water pump or thing used or in respect of which there is reasonable cause to suspect that it has been used in the commission of any offence under regulation 5, 7, 7A, 7B or 15(1) may be seized and detained by an authorised officer.
Where any item is seized under paragraph (1), the authorised officer who carried out the seizure shall give notice in writing of the seizure to the owner of that item, if known, either by delivering the notice personally to him or by post at his place of residence, if known.
The notice shall not be required to be given where the seizure is made in the presence of the offender or owner or his agent.
Every seizure shall be reported to a Magistrate’s Court.
Where it is proved to the satisfaction of the Magistrate’s Court that the item seized was the subject-matter of or was used in the commission of the offence, the Court may order the item seized to be destroyed or disposed of in such manner as the Court may think fit notwithstanding that no person may have been convicted for that offence.
Non-application of certain provisions of this Part
Regulations 3, 4, 5, 6(a), (b), (h), (i), (j), (n), (o) and (p), 7(a) to (h), (j), (l), (m) and (n) and 11 do not apply to any person in the Central Water Catchment Area or a Catchment Area Park if the person is in any area described in Part 1 of the Fourth Schedule.
Despite paragraph (1), this Part continues to apply to the path described in Part 2 of the Fourth Schedule.”.
Permit required for vessel in reservoir or waterway
No person shall operate, have conduct of, place or berth any vessel in a reservoir or waterway, except under and in accordance with a valid vessel permit granted by an authorised officer and any condition imposed in connection therewith.
Paragraph (1) does not apply in respect of —
a power-driven vessel that —
is operated under the authority of the Singapore Armed Forces, Singapore Police Force or Singapore Civil Defence Force; and
is used for —
the operational purposes of the Singapore Armed Forces, Singapore Police Force or Singapore Civil Defence Force; or
the conduct of public events of national significance; or
a non-power-driven vessel that is used —
to prepare for or for any event approved under regulation 24;
within the area designated for that event; and
during the period specified by an authorised officer in connection with the approval granted under regulation 24, during which the vessel may be used in the reservoir or waterway.
Every application for a vessel permit shall be made in such form and manner as the Board may determine and shall be accompanied by ––
a description of each type of vessel in respect of which the permit is sought;
the number of vessels in respect of which the permit is sought;
the activity for which each vessel is to be used in the reservoir or waterway;
any identification number or mark carried by each vessel; and
the name and such other details as the authorised officer may require of the owner of the vessel or vessels and, if the owner is not the operator, of the operator of the vessel or vessels.
A vessel permit may ––
be granted to a single owner or operator in respect of one or more vessels;
specify one or more reservoirs or waterways in which the vessel or vessels may operate; and
be subject to such conditions as may be stated therein.
A vessel permit ––
shall be in such form as the Board may determine;
shall be valid for the period and the purposes stated therein unless it is sooner revoked under these Regulations; and
may be renewed upon its expiry.
An authorised officer may at any time add to, cancel or vary any of the conditions of the permit that he thinks fit.
Requirements for grant of vessel permit for watercraft
No vessel permit shall be granted in respect of a watercraft unless there is shown to the satisfaction of an authorised officer ––
a valid pleasure craft licence or harbour craft licence issued by the Authority in respect of the watercraft;
in the case of any watercraft not falling under paragraph (a), documentary evidence that the watercraft ––
has been inspected and certified safe for use by a marine surveyor approved by the Board; and
has in force for the duration of the permit a policy of insurance which insures the owner or operator of, or any other person using, the watercraft for —
any liability which may be incurred by any of them in respect of the death of or bodily injury to any person caused by, or arising out of, the use of the watercraft;
any liability which may be incurred by any of them in respect of loss of, or damage to, property belonging to any third party caused by, or arising out of, the use of the watercraft;
wreck removal costs; and
oil pollution damage and costs of preventing or reducing damage resulting from the discharge or escape of oil; or
in the case of a watercraft entering a reservoir or waterway from the port, that the watercraft has been allowed by the Authority to enter the port and territorial waters of Singapore.
Conditions of vessel permit
Every holder of a vessel permit shall ensure that the following requirements are complied with at all times that a vessel under the permit is in a reservoir or waterway:
the vessel does not cause oil or other pollutants to be discharged into the reservoir or waterway; and
the hull of the vessel is not painted with paint containing tributyltin, cuprous oxide or other biocides.
Where a vessel permit is granted for one or more watercraft, the holder of the vessel permit shall, in addition, ensure that the following requirements are complied with in respect of each watercraft under the permit:
there is in force such insurance as is referred to in regulation 16(b)(ii) at all times that the watercraft is in a reservoir or waterway;
there is provided on board the watercraft adequate life-saving equipment and fire-fighting equipment;
the watercraft is driven only by a person qualified to do so under regulation 18; and
the person driving the watercraft complies with the navigation rules in Part IV.
No person shall drive watercraft without valid licence
No person shall drive a watercraft in a reservoir or waterway unless ––
he is the holder of a valid powered pleasure craft driving licence or harbour craft manning licence issued by the Authority; or
in the case of a watercraft entering a reservoir or waterway from the port, he is driving a watercraft that has been allowed by the Authority to enter the port and territorial waters of Singapore.
Requirements for operating vessel
The operator of a vessel must ensure that the following requirements are complied with when the vessel is in a reservoir or waterway:
where an authorised officer has sealed a toilet or discharge valve on a vessel to prevent the toilet or discharge valve from being used or opened while the vessel is in a reservoir or waterway, the seal is not removed or damaged;
every person on board the vessel wears a personal flotation device, unless the vessel is a commercial water taxi, a river cruise or an amphibious tour vessel;
the vessel only anchors at an area designated by the Board for anchoring;
the vessel does not berth at a pontoon owned by the Board unless prior written approval is given by an authorised officer;
where an event is approved under regulation 24 and the vessel is not a part of the event —
the vessel keeps clear of the area designated for purposes of the event; and
every person on the vessel complies with any instruction on the safe conduct of the event that is given by any official of the event who has been approved as an official of the event as part of the approval granted under regulation 24;
no washing of the vessel takes place;
the hull of the vessel is not painted with paint containing tributyltin, cuprous oxide or other biocides.
Vessel to be properly secured
The operator of a vessel shall ensure that the vessel is ––
adequately secured when not in use in any reservoir or waterway;
anchored in a designated area and in a manner so as not to obstruct the navigation of other vessels; and
not fastened to any bridge or railing, or other object on land that is not intended for that purpose.
The Board shall not be responsible for —
any improper or insecure moorings of the vessel; or
any defective moorings or appliances.
Overloading
The operator of a watercraft or a non-power-driven vessel shall not cause or permit the watercraft or non-power-driven vessel to carry a greater number of persons than the number allowed by and shown on the vessel permit granted for the use of the watercraft or non-power-driven vessel.
Reporting of incidents
This regulation applies in the event of any of the following incidents:
any fire on board a vessel in a reservoir or waterway;
any collision, accident, breaking-up or damage involving a vessel in a reservoir or waterway;
any person falling overboard from a vessel in a reservoir or waterway.
The operator of the vessel must —
immediately do the following:
in the case of fire, collision, accident, breaking-up or damage — prevent any further deterioration in the condition of the vessel;
ensure the safety of persons on board the vessel and any person who has fallen overboard;
immediately call for emergency services such as police, civil defence or medical services, if necessary;
carry out any rescue and recovery operation, including arranging for the vessel to be towed;
inform an authorised officer of the incident, by the most direct means —
within one hour of the operator becoming aware of the incident — if the incident involves any spillage of oil or other pollutants into the reservoir or waterway; or
within 2 hours of the operator becoming aware of the incident — if the incident does not involve any spillage of oil or other pollutants into the reservoir or waterway;
submit to the authorised officer mentioned in sub-paragraph (d) a full written report providing details of any death, injury to persons, damage to property or any spillage of oil or other pollutants into the reservoir or waterway, within 7 days after the day on which the operator becomes aware that the incident has occurred; and
comply with all instructions given by the authorised officer mentioned in sub-paragraph (d).
Removal of vessels and wrecks
Where, in the opinion of an authorised officer, any vessel, wreck or part thereof found in a reservoir or waterway ––
is obstructing or likely to obstruct the free passage of any person or vessel in the reservoir or waterway; or
should, in the interests of safety or of the public, be moved,the authorised officer may direct the owner or operator of the vessel, wreck or part thereof to move it to another place in, or to remove it from, the reservoir or waterway within a specified time.
Where ––
an authorised officer is unable to give a direction under paragraph (1) by reason of the absence of the owner or operator of the vessel; or
the owner or operator of the vessel fails to comply with a direction made under that paragraph,the authorised officer may carry out the direction in such manner as he thinks fit, and recover all expenses reasonably incurred by him in doing so from the owner or operator of that vessel.
Prohibited activities on vessels
No person shall carry out any repair work to any vessel which will cause pollution within any reservoir or waterway.
No person shall —
throw, discharge or deposit; or
cause to be thrown, discharged or deposited,any rubbish, solid ballast, bilge water, sludge, sewage, grey water, oil, pollutant or any other matter or thing into any reservoir or waterway.
Events or organised activities in reservoir or waterway
No person shall conduct any event or organised activity in a reservoir or waterway without the prior written approval of an authorised officer.
An approval under paragraph (1) may be given subject to such conditions as to time, place or other circumstances as the authorised officer may impose.
Without affecting regulation 39, where a person granted written approval under paragraph (1) for an event or organised activity is also granted an approval under regulation 7B for any structure required to be installed or kept in a reservoir or waterway in connection with the event or organised activity, an authorised officer may revoke the approval granted under paragraph (1) if the person fails to comply with any condition imposed on the approval granted under regulation 7B.
In this regulation —
“event” means —
any race, display, regatta or other sporting event; or
any procession, parade, celebration, ceremony or gathering;
“organised activity” means any equipment rental, or any course, programme or training, that is carried out on a regular basis.
General requirements for event or organised activity
A person to whom an approval under regulation 24(1) is granted to conduct an event or organised activity must ensure that the following requirements are complied with during the event or organised activity:
where the event or organised activity takes place during hours of darkness, the following are visibly lit during those hours of darkness:
any pontoon used for the event or organised activity;
any buoy used for the event or organised activity;
any area designated by the authorised officer for the event or organised activity;
the event or organised activity, and any related activities, are held within the areas in the reservoir or waterway that are designated for the event or organised activity;
any pontoon or buoy used for the event or organised activity does not become a hazard to the navigation of vessels;
adequate measures are undertaken to ensure the safety of persons participating in the event or organised activity and the general public;
the carrying out of the event or organised activity is suspended and no person involved in the event or organised activity enters into or remains in the reservoir or waterway, if —
there is any inclement weather leading to poor visibility;
a lightning or heavy rain alert is issued by the National Environment Agency’s Meteorological Service Singapore in respect of the areas in the reservoir or waterway that are designated for the event or organised activity; or
the authorised officer in his discretion deems that conditions are unsafe for the carrying out of the event or organised activity;
the authorised officer is notified in accordance with paragraph (2) if any incident occurs during the event or organised activity that —
endangers or harms human life, or injures any person;
destroys or damages the property of the Board or any property under the management or control of the Board; or
pollutes the water in the reservoir or waterway;
there is in force a policy of insurance insuring the organiser of the event or organised activity against —
any liability which may be incurred by the organiser in respect of the death of, or bodily injury sustained by, any person caused by, or arising out of, the event or organised activity;
any liability which may be incurred by the organiser in respect of any loss of, or damage to, property belonging to any third party caused by, arising out of, or in connection with the event or organised activity; and
any pollution damage and costs of preventing or reducing damage resulting from the discharge or escape of any pollutant arising out of or in connection with the event or organised activity.
For the purposes of paragraph (1)(f), the person mentioned in paragraph (1) must —
inform an authorised officer of the incident, by the most direct means —
within one hour of the person becoming aware of the incident — if the incident involves any spillage of oil or other pollutants into the reservoir or waterway; or
within 2 hours of the person becoming aware of the incident — if the incident does not involve any spillage of oil or other pollutants into the reservoir or waterway; and
submit to the authorised officer mentioned in sub-paragraph (a) a written report on the incident in the form required by the authorised officer, within 7 days after the day on which the person becomes aware that the incident has occurred.
Vessel used during event or organised activity
A person to whom an approval under regulation 24(1) is granted to conduct an event or organised activity must ensure that the following requirements are complied with in respect of every vessel used during the event or organised activity:
where the event or organised activity takes place during hours of darkness, all vessels used during those hours of darkness are visibly lit during those hours of darkness;
any towing of a vessel is carried out at the time, and using the route, determined by an authorised officer;
the vessel only enters or leaves the reservoir or waterway at the launching site designated in the approval.
Application of this Part
Unless the context otherwise requires, this Part shall apply to any vessel in any reservoir or waterway.
Look-out
Every vessel shall at all times maintain a proper look-out by sight and hearing as well as by all available means appropriate in the prevailing circumstances and conditions so as to make a full appraisal of the situation and of the risk of collision.
Safe speed for vessel
Every vessel shall at all times proceed at a safe speed so that she can take proper and effective action to avoid collision and be stopped within a distance appropriate to the prevailing circumstances and conditions.
In determining a safe speed, the following factors shall be taken into account:
the state of visibility;
the traffic density;
the manoeuvrability of the vessel with special reference to stopping distance and turning ability in the prevailing conditions;
at night the presence of background light such as from shore lights or from back scatter of her own lights;
the state of wind and current, and the proximity of navigational hazards; and
the draught in relation to the available depth of water.
Risk of collision
Every vessel shall use all available means appropriate to the prevailing circumstances and conditions to determine if risk of collision exists.
In determining if risk of collision exists, the following considerations shall be taken into account:
such risk shall be deemed to exist if the compass bearing of an approaching vessel does not appreciably change;
such risk may sometimes exist even when an appreciable bearing change is evident, particularly when approaching a very large vessel or a tow or when approaching a vessel at close range; and
if there is any doubt, such risk shall be deemed to exist.
Action to avoid collision
Any action taken to avoid collision shall, if the circumstances of the case admit, be positive, made in ample time and with due regard to the observance of good seamanship.
Action taken to avoid collision with another vessel shall be such as to result in passing at a safe distance.
The effectiveness of the action of a power-driven vessel under paragraph (2) shall be carefully checked until the other vessel is finally past and clear.
If necessary to avoid collision or allow more time to assess the situation, a power-driven vessel shall slacken her speed or take all way off by stopping or reversing her means of propulsion.
A vessel, the passage of which is not to be impeded, remains fully obliged to comply with these Regulations when the 2 vessels are approaching one another so as to involve risk of collision.
Steering rules
Where 2 sailing vessels are approaching one another, so as to involve risk of collision ––
when each vessel has the wind on a different side, the vessel which has the wind on the port side shall keep out of the way of the other vessel;
when both vessels have the wind on the same side, the vessel which is to windward shall keep out of the way of the vessel that is to leeward; and
when a vessel with the wind on the port side has a vessel to windward and cannot determine with certainty whether that other vessel has the wind on the port side or starboard side, the first-mentioned vessel shall keep out of the way of the other vessel.
For the purposes of paragraph (1), the side opposite the side on which the mainsail is carried shall be regarded as the windward side.
Where 2 power-driven vessels are meeting on reciprocal or nearly reciprocal courses, so as to involve risk of collision, each vessel shall alter her course to starboard so that each vessel shall pass on the port side of the other vessel.
Where 2 power-driven vessels are crossing, so as to involve risk of collision, the vessel that has the other vessel on its own starboard side shall keep out of the way of that other vessel.
Where a power-driven vessel and a sailing vessel are approaching one another, so as to involve risk of collision, the power-driven vessel shall keep out of the way of the sailing vessel.
Where a vessel propelled by oars and a sailing vessel are approaching one another, so as to involve risk of collision, the vessel propelled by oars shall keep out of the way of the sailing vessel.
Where a power-driven vessel and a vessel propelled by oars are approaching one another, so as to involve risk of collision, the power-driven vessel shall keep out of the way of the vessel propelled by oars.
Any vessel proceeding along the course of a narrow channel or fairway shall keep as near to the starboard side of the channel as is safe and practicable.
Course and speed to be kept
Where one of 2 vessels is to keep out of the way, the other vessel shall keep her course and speed until the vessels are clear of one another, unless to do so would involve risk of collision.
Restriction on crossing ahead
A vessel that is required to keep out of the way of another vessel shall, if practicable, keep from crossing ahead of the other vessel.
Power-driven vessel to slacken speed
A power-driven vessel that is required to keep out of the way of another vessel shall, on approaching that other vessel, if necessary to avoid collision, slow down, stop or reverse.
Overtaking vessel
A power-driven vessel or sailing vessel that is overtaking another vessel shall keep out of the way of the other vessel.
A power-driven vessel or sailing vessel coming up with another vessel from a direction of more than 22.5° abaft that other vessel’s beam is taken to be an overtaking vessel.
Use of designated zones
Subject to paragraph (3) ––
every power-driven vessel shall navigate only within the limits of the zone in a reservoir or waterway designated for power-driven vessels; and
every non-power-driven vessel shall navigate only within the limits of the zone in a reservoir or waterway designated for non-power-driven vessels.
The Board may define the limits of the designated zones in a reservoir or waterway for power-driven vessels and non-power-driven vessels by bearings, buoys or other means.
This regulation shall not apply to ––
any vessel approved by the Board for patrolling, rescue or general reservoir or waterway maintenance work or any vessel of the Singapore Armed Forces, Police Coast Guard or Singapore Civil Defence Force; or
any vessel which has obtained the prior written approval of an authorised officer to navigate outside the limits of the zone designated for the vessel.
Navigation lights
A power-driven vessel underway on a reservoir or waterway at night shall show ––
a masthead light forward;
sidelights; and
a sternlight,but, in the following cases, may opt to show the specified lights in lieu thereof:
if the vessel is less than 12 metres in length ––
an all-round white light and sidelights; or
a masthead light or an all-round white light which may be displaced from the fore and aft centreline of the vessel, provided that the sidelights are combined in one lantern carried on the fore and aft centreline of the vessel or located as nearly as practicable in the same fore and aft line as the masthead light or the all-round white light;
if the vessel is less than 7 metres in length and has a maximum speed not exceeding 7 knots, an all-round white light and, if practicable, sidelights.
A sailing vessel underway on a reservoir or waterway at night shall show —
sidelights; and
a sternlight,but, in the following cases, may opt to show the specified lights in lieu thereof:
if the vessel is less than 20 metres in length, the sidelights and sternlight may be combined in one lantern carried at or near the top of the mast where it can best be seen;
if the vessel is less than 7 metres in length, an electric torch or lighted lantern showing a white light ready at hand which shall be shown in sufficient time to prevent collision.
A vessel under oars on a reservoir or waterway at night may show the lights specified in paragraph (2) for a sailing vessel, but if she does not, she shall have ready at hand an electric torch or a lighted lantern showing a white light which shall be shown in sufficient time to prevent a collision.
The lights required to be shown under paragraph (1) or (2) shall be of an intensity so as to be visible at the following minimum ranges:
in a vessel of 12 metres or more in length but less than 50 metres in length ––
masthead light, 5 miles; except that where the length of the vessel is less than 20 metres, 3 miles;
sidelights, 2 miles;
sternlight, 2 miles;
white all-round light, 2 miles; and
in a vessel of less than 12 metres in length ––
masthead light, 2 miles;
sidelights, 1 mile;
sternlight, 2 miles;
white all-round light, 2 miles.
In this regulation ––
“all-round light” means a light showing an unbroken light over an arc of the horizon of 360°;
“masthead light” means a white light placed over the fore and aft centreline of the vessel showing an unbroken light over an arc of the horizon of 225° and so fixed as to show the light from right ahead to 22.5° abaft the beam on either side of the vessel;
“sidelights” means a green light on the starboard side and a red light on the port side each showing an unbroken light over an arc of the horizon of 112.5° and so fixed as to show the light from right ahead to 22.5° abaft the beam on its respective side;
“sternlight” means a white light placed as nearly as practicable at the stern showing an unbroken light over an arc of the horizon of 135° and so fixed as to show the light of 67.5° from right aft on each side of the vessel.
Reckless or negligent conduct of vessel or conduct while intoxicated
No person shall navigate a vessel in a reservoir or waterway —
recklessly or negligently; or
at such a speed, or otherwise in any way, that is —
dangerous or likely to cause injury to any person or damage to his property; or
likely to cause annoyance or be a nuisance to any person.
No person shall have conduct of any vessel in a reservoir or waterway while he is under the influence of drink or a drug or an intoxicating substance to such extent as —
to be incapable of having proper control of the vessel; or
to endanger the safety of the vessel or any other person.
Offence
Where any of the regulations in this Part is contravened, any person for the time being having conduct of the vessel and the operator of the vessel shall each be guilty of an offence and shall be liable on conviction to a fine not exceeding $10,000.
It shall be a defence for any person charged with an offence under paragraph (1) to show that he took all reasonable precautions to avoid commission of the offence.
