Preliminary assessment report
Subregulation 1
Where the court calls for a preliminary assessment report for the purpose of making a determination under section 13B(3)(a) of the Act, the court may make an order under section 13B(6) of the Act in the appropriate Form or Form 15, as the case may be.
Subregulation 2
The preliminary assessment report may be disclosed to the applicant for the mandatory treatment order to which the report relates (if any) only if the applicant —
applies for permission to appeal against a decision of the court not to call for a formal assessment report; and
gives an undertaking to pay damages in the event of improper use or disclosure of the report, as the court may require.
