Regulation 75
Act for which payment is required need not be performed until payment is made
Subregulation 1
Where the court is required to do anything for which a fee is to be paid under the Act or these Rules, the court may decline to do that thing until the fee is paid or payment is made, and the court may make such directions as it deems fit, including the dismissal of the matter.
Subregulation 2
If a fee to be paid under the Act or these Rules is not received by the Registrar within the prescribed time, the claim, response, application or reply (as the case may be) to which the fee relates, is deemed to be withdrawn, and no further notice need be given by the court to any party.
Subregulation 3
Failure to pay the fee does not preclude a party from filing the claim, response, application or reply (as the case may be) again, but the Registrar may revoke or suspend the approval to file such claim, response, application or reply.
