Appeal against notice to maintain

Subregulation 1

For the purposes of section 25F(1) of the Act, a person who intends to appeal against a notice to maintain served under section 25E(4) of the Act may file an appeal in accordance with paragraph (2).

Subregulation 2

The appeal must —

(a)

be addressed to the Permanent Secretary, Ministry of National Development;

(b)

be sent by email to MND_HQ@mnd.gov.sg;

(c)

contain —

(i)

a summary of the grounds of appeal; and

(ii)

a succinct presentation of the appellant’s arguments of fact or law supporting each ground of appeal; and

(d)

be accompanied by a copy of the following documents:

(i)

the notice to maintain served on the appellant;

(ii)

any other correspondence between the appellant and the Commissioner of Building Control in relation to the notice to maintain;

(iii)

any other document supporting the ground of the appeal or argument of fact or law.
