Regulation 44C

This regulation applies in relation to any boundary gate or boundary fence, that is a structure or part of a building.

If a boundary gate or boundary fence is in a state that it will collapse or be likely to collapse, the owner or owners of the boundary gate or boundary fence must ensure that it is repaired without delay.

Any person who contravenes paragraph (2) shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $10,000.

In this regulation, “boundary fence” means any fence along the boundary of a property, and includes a boundary wall fence but does not include a retaining wall.
