Amendment of section 4
of Health Sciences Authority (Amendment) and Other Matters Bill
In the HBR Act, in section 4 —
replace subsection (2) with —“(2) The Chief Executive may —
appoint a public officer or an officer of a public authority to be an authorised officer to exercise the powers conferred on authorised officers under Part 8; and
appoint a public officer, an officer of a public authority or any suitably qualified individual to be an auxiliary authorised officer to exercise the powers conferred on auxiliary authorised officers under Part 8.”;
in subsections (3) and (4), after “Every authorised officer”, insert “or auxiliary authorised officer”;
in subsections (3) and (4), after “the authorised officer”, insert “or auxiliary authorised officer”;
in subsection (5), after “authorised officer”, insert “or any auxiliary authorised officer who is a public officer or an officer of a public authority”; and
replace subsections (6) and (7) with —“(6) The Chief Executive may appoint, subject to any restrictions specified in the appointment, a suitably qualified individual who is neither a public officer nor an officer of a public authority to assist the Chief Executive in the administration of this Act.
Every authorised officer, auxiliary authorised officer or individual appointed under subsection (6), who is not otherwise a public servant under section 21 of the Penal Code 1871, is taken to be one for the purposes of that Code.”.
