Regulation 5

Prohibited use of psychoactive substances

Subregulation 1

A person must not operate an unmanned aircraft, or be involved in the conduct of a flight involving an unmanned aircraft, if the person is under the influence of any psychoactive substance to such extent as to be unable to operate the unmanned aircraft in a safe and proper manner.

Subregulation 2

A person who contravenes paragraph (1) shall be guilty of an offence and shall be liable on conviction —

(a)

for a first offence, to a fine not exceeding $50,000 or to imprisonment for a term not exceeding 2 years or to both; and

(b)

for a second or subsequent offence, to a fine not exceeding $100,000 or to imprisonment for a term not exceeding 5 years or to both.

Subregulation 3

In a prosecution for an offence under paragraph (2), it is not necessary for the prosecution to prove that the person charged with the offence intended to commit the offence.
