Regulation 43

Within 3 months after the date of receipt by the registered owner of the copy of the applicant’s evidence referred to in rule 42, the registered owner shall file with the Registrar such evidence by way of a statutory declaration as the registered owner may desire to adduce in support of his registration and shall, at the same time, serve on the applicant a copy of that evidence.

If the registered owner does not file or serve any evidence in accordance with paragraph (1), he shall, unless the Registrar otherwise directs, be deemed to have admitted to the facts alleged by the applicant in his application for revocation.
