Regulation 35C

Restoration of registration

Subregulation 1

A person may apply to restore a design which has been removed, on or after 13 November 2014, from the Register under rule 35B by —

(a)

filing an application with the Registrar in Form D8 within 6 months after the last day of the first 6‑month period after the date on which the design is removed from the Register; and

(b)

paying the fees for the restoration of the design and the extension of the period of registration of the design after the design is restored.

Subregulation 2

The Registrar may, in any case, require the applicant for restoration to furnish such additional evidence or information, by statutory declaration or otherwise, as the Registrar thinks fit, within such time as the Registrar may specify.

Subregulation 3

The Registrar may restore the design to the Register and renew the registration of the design if he is satisfied that it is just to do so, and upon such conditions as he may think fit to impose.
