Regulation 42

Within 3 months after the date the applicant receives the counter-statement from the registered owner, the applicant shall file with the Registrar such evidence by way of a statutory declaration as he may desire to adduce in support of his application and shall, at the same time, serve on the registered owner a copy of that evidence.

If the applicant does not file or serve any evidence in accordance with paragraph (1), the application shall, unless the Registrar otherwise directs, be treated as withdrawn.
