Regulation 38
Safety of equipment
Where any person uses any equipment in a shipyard or on board a ship in a harbour for the purpose of any work to which these Regulations apply, it shall be the duty of —
(a)
the employer of the person; or
(b)
the principal under whose direction the person carries out the work,to ensure that the equipment is —
(i)
of good construction, sound material and adequate strength;
(ii)
free from defects; and
(iii)
appropriate for the work for which it is to be used.
