Requirements for deviation from approved plans
Subregulation 1
Where it is desired that any building works deviate from the approved plans of those building works, an application shall be made to the Commissioner of Building Control under section 5A(1) of the Act and shall, without prejudice to that section, be accompanied by the amended plan of the buildings works showing clearly the departures or deviations.
Subregulation 2
Where the deviations involve material changes to the structural design, the qualified person appointed under section 8(1)(a) or 11(1)(d)(i) of the Act and, in the case of major building works, the accredited checker shall submit the structural plans and design calculations to the Commissioner of Building Control for approval before construction.
Subregulation 2A
Where the deviations involve material changes to building works other than the structural design, the qualified person appointed under section 8(1)(a) or 11(1)(d)(i) of the Act shall submit the building plans to the Commissioner of Building Control for approval before construction.
Subregulation 3
Notwithstanding paragraph (1), where the departures or deviations involve immaterial changes to the structural design, the qualified person appointed under section 8(1)(a) or 11(1)(d)(i) shall only be required to prepare and submit to the Commissioner of Building Control —
the record plans;
his certificate stating that to the best of his knowledge and belief the departures or deviations do not affect the structural adequacy or stability of the building;
a certificate from an accredited checker stating that to the best of his knowledge and belief, the record plans do not show any inadequacy in key structural elements of the building to be erected or affected by building works carried out in accordance with those plans; and
on the completion of the building works, a report stating the departures and deviations accompanied by the detailed structural plans and design calculations showing such departures and deviations.
Subregulation 3A
Notwithstanding paragraph (1), where the departures or deviations involve immaterial changes to building works other than the structural design, the qualified person appointed under section 8(1)(a) or 11(1)(d)(i) of the Act shall only be required to prepare and submit to the Commissioner of Building Control —
the record plans;
his certificate stating that to the best of his knowledge and belief, the departures or deviations —
have been completed in accordance with the provisions of the Act and these Regulations; and
do not affect the objectives and performance requirements set out in the Fifth Schedule relating to the approved plans; and
such other certificate or document as may be required by the Commissioner of Building Control.
Subregulation 4
The qualified person appointed under section 8(1)(a) or 11(1)(d)(i) of the Act shall keep and maintain a record of all departures and deviations relating to the structural elements of the building works.
Subregulation 5
The certificates referred to in paragraphs (3)(b) and (c) and (3A)(b) and (c) shall be in such form as the Commissioner of Building Control may specify.
Subregulation 6
Every application under section 5A(1) of the Act must be accompanied by the appropriate fee specified in the Second Schedule.
