Replacement of section 27
of Civil Defence Shelter and Fire Safety (Miscellaneous Amendments) Bill
In the FS Act, replace section 27 with —“Offence for any person to cause fire hazards
27. A person commits an offence if the person —
causes, or does any act which is likely to cause, any of the following:
any fire safety measure in any premises (including any external fire safety measure) not to be in proper working order;
the obstruction of any access road, accessway or other installation that is provided, used or designed to be used for the purpose of providing access to any building in order to extinguish, attack, prevent or limit a fire in or at the building;
the obstruction of or any interference with the normal operation of any fire safety measure in any building such as might prevent or impede the timely and effective use of the fire safety measure;
the obstruction of or any interference with the normal operation of any external fire safety measure such as might prevent or impede the timely and effective use of the external fire safety measure;
the obstruction of any escape route, passageway, common property or limited common property of any building —
such as might render escape in the event of fire more difficult; and
which obstruction cannot be easily removed by an individual escaping from a fire; and
knows or ought to know that the act causes or is likely to cause the effect mentioned in paragraph (a)(i), (ii), (iii), (iv) or (v), as the case may be.”.
