Replacement of section 78
of Civil Defence Shelter and Fire Safety (Miscellaneous Amendments) Bill
In the FS Act, replace section 78 with —“Storage of petroleum and flammable materials
78. A person must not store or keep, or cause to be stored or kept, any class of petroleum or any flammable material unless either of the following applies:
the person stores or keeps, or causes to be stored or kept, such class of petroleum or flammable material —
in or on licensed premises;
under the authority of and in accordance with the provisions of a storage licence granted by the Commissioner for the licensed premises and every condition specified in that licence; and
in such quantities, in such manner and in accordance with such requirements as are prescribed in relation to such class of petroleum or flammable material;
the person is a class licensee authorised under a class licence to store or keep, or cause to be stored or kept, such class of petroleum or flammable material in or on any applicable premises.”.
