Amendment of section 18
of Civil Defence Shelter and Fire Safety (Miscellaneous Amendments) Bill
In the FS Act, in section 18 —
after subsection (1), insert —“(1A) The power to require a person to provide any information or produce any book or document under subsection (1)(c) includes the power —
to require that person to provide an explanation of the information, book or document;
if the information is not provided or the book or document is not produced, to require that person to state, to the best of that person’s knowledge and belief, where it is; and
if the information is recorded otherwise than in legible form, to require the information to be made available to the Commissioner or authorised member in legible form.”;
in subsection (4)(a), replace “any information or produce any book or document, or any copy of the book or document, required” with “any information or explanation, produce any book or document, or any copy of the book or document, or comply with any other requirement”;
in subsection (4)(c), after “information”, insert “or explanation”; and
in subsection (4)(d), replace “information” with “any information or explanation”.
