In the FS Act, replace section 81 with —“Dispensing of petroleum and flammable materials

81. A person must not dispense or cause to be dispensed any class of petroleum or any flammable material unless either of the following applies:

(a)

the person dispenses or causes to be dispensed such class of petroleum or flammable material —

(i)

in or on licensed premises;

(ii)

in accordance with the provisions of the storage licence for the licensed premises and every condition specified in that licence; and

(iii)

in the case of the dispensing of any class of petroleum or any flammable material into —

(A)

any prescribed type of container;

(B)

any road tanker; or

(C)

the fuel tank of any vehicle,where the regulations require a person so dispensing that class of petroleum or flammable material to have the Commissioner’s specific approval, with such approval and in accordance with any conditions that the Commissioner may impose;

(b)

the person —

(i)

is a class licensee authorised under a class licence to store or keep, or cause to be stored or kept, such class of petroleum or flammable material in or on any applicable premises; and

(ii)

dispenses or causes to be dispensed such class of petroleum or flammable material in or on the applicable premises in accordance with the conditions of the class licence.”.
