Replacement of section 109
of Civil Defence Shelter and Fire Safety (Miscellaneous Amendments) Bill
In the FS Act, replace section 109 with —“False or misleading information109.—
Any person who provides, to the Commissioner or a licensing officer in connection with any application for a licence or permit under this Act, any information that the person knows or has reason to believe is false or misleading, or is reckless or negligent as to whether the information is false or misleading, shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $10,000 or to imprisonment for a term not exceeding 6 months or to both.
Any person to whom a class licence applies who, pursuant to —
a condition precedent of the class licence requiring the person to notify the Commissioner of the person’s identity and other particulars about the regulated activity carried on by the person, or provide any other information to the Commissioner; or
a condition of the class licence requiring the person to provide information to the Commissioner for any purpose or in relation to any matter relating to the class licence,provides any information to the Commissioner, and —
knows or has reason to believe that the information is false or misleading; or
is reckless or negligent as to whether the information is false or misleading,shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $10,000 or to imprisonment for a term not exceeding 6 months or to both.”.
