Regulation 22
Removal of vessels and wrecks
Subregulation 1
Where, in the opinion of an authorised officer, any vessel, wreck or part thereof found in a reservoir or waterway ––
is obstructing or likely to obstruct the free passage of any person or vessel in the reservoir or waterway; or
should, in the interests of safety or of the public, be moved,the authorised officer may direct the owner or operator of the vessel, wreck or part thereof to move it to another place in, or to remove it from, the reservoir or waterway within a specified time.
Subregulation 2
Where ––
an authorised officer is unable to give a direction under paragraph (1) by reason of the absence of the owner or operator of the vessel; or
the owner or operator of the vessel fails to comply with a direction made under that paragraph,the authorised officer may carry out the direction in such manner as he thinks fit, and recover all expenses reasonably incurred by him in doing so from the owner or operator of that vessel.
