Regulation 21

any fire on board a vessel in a reservoir or waterway;

any collision, accident, breaking-up or damage involving a vessel in a reservoir or waterway;

any person falling overboard from a vessel in a reservoir or waterway.

immediately do the following:

in the case of fire, collision, accident, breaking-up or damage — prevent any further deterioration in the condition of the vessel;

ensure the safety of persons on board the vessel and any person who has fallen overboard;

immediately call for emergency services such as police, civil defence or medical services, if necessary;

carry out any rescue and recovery operation, including arranging for the vessel to be towed;

inform an authorised officer of the incident, by the most direct means —

within one hour of the operator becoming aware of the incident — if the incident involves any spillage of oil or other pollutants into the reservoir or waterway; or

within 2 hours of the operator becoming aware of the incident — if the incident does not involve any spillage of oil or other pollutants into the reservoir or waterway;

submit to the authorised officer mentioned in sub-paragraph (d) a full written report providing details of any death, injury to persons, damage to property or any spillage of oil or other pollutants into the reservoir or waterway, within 7 days after the day on which the operator becomes aware that the incident has occurred; and

comply with all instructions given by the authorised officer mentioned in sub-paragraph (d).
