Regulation 38
Offence
Subregulation 1
Where any of the regulations in this Part is contravened, any person for the time being having conduct of the vessel and the operator of the vessel shall each be guilty of an offence and shall be liable on conviction to a fine not exceeding $10,000.
Subregulation 2
It shall be a defence for any person charged with an offence under paragraph (1) to show that he took all reasonable precautions to avoid commission of the offence.
