36. Amendment of section 21

In the EVCA, in section 21 —

in subsection (1)(c), replace “section 25(1)” with “section 25(1) or 25A(2)”;

after subsection (1), insert —“(1A) Unless not practicable in the circumstances, the LTA must, before cancelling the registration of a registered-for-charging EV charger under subsection (1) on a ground mentioned in that provision (other than the ground in subsection (1)(d)), give written notice to the registered responsible person for the EV charger —

stating that the LTA intends to cancel the registration;

specifying the grounds for the proposed cancellation; and

specifying the time (being at least 7 days after the date of service of notice on the registered responsible person) within which written representations may be made to the LTA with respect to the proposed cancellation.

The LTA may, after considering any written representation under subsection (1A)(c), decide to cancel the registration of the registered‑for‑charging EV charger as the LTA considers appropriate.

Where the LTA decides to cancel the registration of the registered‑for‑charging EV charger, the LTA must serve a written notice of its decision on the registered responsible person of the EV charger.

A decision to cancel the registration of a registered‑for‑charging EV charger takes effect from the date on which the written notice under subsection (1C) is served, or on such other date as may be specified in the written notice (called in this section the cancellation date).”; (c)in subsection (2), after “section 20(1)(c)”, insert “as in force immediately before the date of commencement of section 35 of the Land Transport and Related Matters (No. 2) Act 2026”; and

in subsection (2), replace “the LTA informs the registered responsible person of the cancellation” with “the cancellation date”.
