5. Amendment of section 15

In the AMA, in section 15, after subsection (4), insert —“(5) An individual who, without reasonable excuse, contravenes subsection (1) and does so using a non‑compliant bicycle, a non‑compliant PAB or a non‑compliant personal mobility device knowing that, or reckless as to whether, the bicycle, PAB or personal mobility device is non‑compliant shall be guilty of an offence and shall be liable on conviction —

to a fine not exceeding $10,000 or to imprisonment for a term not exceeding 6 months or to both; but(b)where the individual is a repeat offender, to a fine not exceeding $20,000 or to imprisonment for a term not exceeding 12 months or to both.”.
