40. Amendment of section 29

In the EVCA, in section 29, after subsection (2), insert —“(2A) For the purposes of subsection (1)(a), using an EV charger for a purpose includes using the EV charger to —

charge any vehicle, item or article that is chargeable; or

power any electrical appliance, item or article.

In any proceedings for an offence under subsection (1) —

where it is proved that the person connected the connector of an EV charger to the inlet of the vehicle, item or article, it is presumed, until the contrary is proved, that the person had used the EV charger to charge the vehicle, item or article; and

where it is proved that the person connected the connector of the EV charger to the inlet of the electrical appliance, item or article, it is presumed, until the contrary is proved, that the person had used the EV charger to power the electrical appliance, item or article.”.
