Regulation 7B
Installing or keeping structure in reservoir, stream or waterway
Subregulation 1
A person must not install or keep any structure in a reservoir, stream or waterway except under and in accordance with a valid approval granted by an authorised officer and any condition imposed in connection with the approval.
Subregulation 2
Paragraph (1) does not apply to any structure in a reservoir, stream or waterway that is installed or kept by the Board.
Subregulation 3
Every application for an approval must be in the form and manner determined by the Board.
Subregulation 4
If a person installs or keeps a structure in a reservoir, stream or waterway in contravention of paragraph (1), an authorised officer may issue a direction to the person to move or remove the structure or any part of the structure within the time specified by the authorised officer.
Subregulation 5
To avoid doubt, an authorised officer may issue more than one direction to the same person to move or remove the structure or part of the structure (as the case may be) within a specified time, so long as the person has not complied with any direction previously given to the person to so move or remove the structure or part of the structure.
Subregulation 6
In granting an approval under paragraph (1), the authorised officer may impose any conditions that he thinks fit, including that the structure operator of the structure must —
inspect and maintain the structure at intervals specified by the Board;
implement and maintain any mitigation measures that are required by the Board to preserve the treatability of the water in the reservoir, stream or waterway, including all or any of the following:
an online monitoring system;
a water quality sampling regime;
any other mitigation measure that is required by the Board;
keep records of —
the inspections and maintenance of the structure carried out under sub-paragraph (a); and
the implementation and maintenance of mitigation measures carried out under sub-paragraph (b),and if so required, submit the records to the Board; and
during the period that the structure is being installed, ensure that the structure is installed in accordance with any requirements that the Board may impose.
Subregulation 7
A condition mentioned in paragraph (6) may impose an obligation on or otherwise apply to a structure operator who is not the approval holder for the structure, but the Board must serve a written notice of the condition on the structure operator.
Subregulation 8
An authorised officer may at any time add to, cancel or vary any of the conditions of the approval that he thinks fit.
Subregulation 9
If a person fails to comply with a condition imposed on an approval, an authorised officer may direct the person to comply with the condition within the time specified by the authorised officer.
Subregulation 10
If a person fails to comply with a direction issued under paragraph (4) or (9), an authorised officer may take all necessary steps to —
move or remove the structure or any part of the structure; or
carry the direction into effect.
Subregulation 11
In this regulation —
Definition
“approval holder” means a person to whom an approval has been granted under paragraph (1);
Definition
“structure operator”, in relation to a structure, means —
during the period that the structure is being installed —
the approval holder for the structure;
the owner of the structure;
any person who installed the structure; or
any person who caused the installation of the structure; and
after the structure has been installed —
the approval holder for the structure;
the owner of the structure; or
any person who ordinarily has charge of, or management or control over, the operation or maintenance of the structure (whether or not the person is the approval holder for the structure).
