Regulation 11A

Transportation, storage and use of fireworks in Central Water Catchment Area, Catchment Area Park or waterway

Subregulation 1

A person must not transport, store or use any fireworks in the Central Water Catchment Area, in a Catchment Area Park or in a waterway except under and in accordance with a valid approval granted by an authorised officer and any condition imposed in connection with the approval.

Subregulation 2

Every application for an approval must —

(a)

be in the form and manner determined by the Board; and

(b)

be accompanied by a plan specifying the manner in which the fireworks are intended to be transported, stored or used.

Subregulation 3

In considering whether to grant an approval under paragraph (1), the authorised officer must consider the risk of all of the following:

(a)

any harm to the safety, health or wellbeing of persons in or around the Central Water Catchment Area, Catchment Area Park or waterway;

(b)

any damage to any structure or other property in or around the Central Water Catchment Area, Catchment Area Park or waterway;

(c)

any pollution to the water in the Central Water Catchment Area, Catchment Area Park or waterway.

Subregulation 4

An approval holder must —

(a)

use the fireworks in a fireworks display session in the manner specified in the plan submitted under paragraph (2)(b); and

(b)

after a fireworks display session, recover —

(i)

all casings and shells, or parts thereof; and

(ii)

all debris,from the fireworks that were used during the session, and properly dispose of the same —

(iii)

within the time specified by the authorised officer in the approval, or any further time that the authorised officer may allow; and

(iv)

in accordance with the directions of the authorised officer.

Subregulation 5

The conditions imposed under paragraph (1) may include a requirement that, after a fireworks display session, the approval holder must submit a written report to the authorised officer within 7 days after the day on which the session concluded on the amount of fireworks used and the amount of fireworks undischarged or unspent.

Subregulation 6

An authorised officer may at any time add to, cancel or vary any of the conditions of the approval that he thinks fit.

Subregulation 7

If an approval holder fails to comply with —

(a)

a condition imposed on the approval; or

(b)

paragraph (4)(b) in respect of sub-paragraph (iii) or (iv),an authorised officer may direct the approval holder to rectify the non-compliance within the time specified in the direction, or any further time that the authorised officer may allow.

Subregulation 8

If the approval holder fails to comply with a direction under paragraph (7), the authorised officer may do all or any of the following:

(a)

revoke the approval granted under paragraph (1);

(b)

where a permit under regulation 15(1) has been granted in connection with the use of the fireworks — revoke the permit granted under that regulation;

(c)

where an approval under regulation 24(1) has been granted in connection with the use of the fireworks — revoke the approval granted under that regulation.

Subregulation 9

If a person transports, stores or uses any fireworks in the Central Water Catchment Area, a Catchment Area Park or a waterway without obtaining an approval to do so from an authorised officer, the authorised officer may do either or both of the following:

(a)

where a permit under regulation 15(1) has been granted in connection with the use of the fireworks — revoke the permit granted under that regulation;

(b)

where an approval under regulation 24(1) has been granted in connection with the use of the fireworks — revoke the approval granted under that regulation.

In this regulation, “approval holder” means a person to whom an approval has been granted under paragraph (1).
