Clause 49

in section 2(1), in the definition of “authorised officer”, replace “any officer” with “any public officer or officer of a public authority”;

in section 2(1), after the definition of “personal care”, insert —“ “public authority” means a body established or constituted by or under a public Act to perform or discharge a public function, but does not include a Town Council established under section 4 of the Town Councils Act 1988;”; and

replace section 42 with —“Protection from personal liability

any authorised officer;

any member of any Medifund committee; or

any person acting under the directions or authorisation of the Medifund committee,who, acting in good faith and with reasonable care, does or omits to do anything in the execution or purported execution of this Act.”.
